TERMS AND CONDITIONS OF SALE
The terms of this agreement and indemnity are deemed to be accepted by both parties even if supply is made on verbal order only.
- Payment shall be made in full on due date without demand, failing which the Supplier shall be entitled without predjudice to any other rights the supplier may have at law and at its option and without notice to: 1) cancel the sale, reposess the goods (ownership of which shall remain with the supplier until the purchase price has been paid in full) and retain all monies paid as liquidated damages and or 2) Claim payment of the full outstanding balance without predjudice to any other rights the supplier may have at law.
- The Supplier reserves the right to cancel this order and refund any money paid should any unforeseen problem exist, which in the opinion of the Supplier prohibits the installation of the product ordered.
- In the event of cancellation due to a breach of this order by the Purchaser, then the Supplier shall be entitled to reasonable costs incurred.
- Although the Supplier shall take all reasonable precautions to prevent any damages on site. The Supplier cannot be held responsible for
damages caused to plants or property whilst carrying out it’s normal duties on site. The purchaser accepts responsibility for repairing
latent defects which could be discovered in the pool coping which may adversely affect the installation.
- All materials and labour supplied are covered by a warranty limited for a period of two years from date of purchase.
- The Safety Net is an aid to safety and as such should be supervised and handled responsibly by adults at all times in the interests of safety, like many other household objects can itself become a hazard if it is not fully fitted, or fully removed, or handled with caution and safety in mind. If the “Pool Safety Net” is not in use, it should be safely stored until required for the purpose it was intended.
- Routine maintenance will be carried out by the Purchaser to ensure that: 1) The net is safely secured at all anchor points 2) The net is sufficiently tensioned to carry the weight of a child. 2) The clearance between the water level and the net is adequate to ensure safety at all times and especially after heavy rainfall.
- In the unlikely event that the “Pool Safety Net” should become defective for any reason which may adversely affect the functional safety for which it was intended, the net should be removed from the pool until repairs have been affected.
- The Supplier should be advised both telephonically and in writing of any defects in the product or labour supplied.
- No variation , addition, deletion or alteration of the agreement and of this clause shall be of any force and effect unless reduced to writing and signed by both parties. This agreement forms the entire agreement between the parties and no other warranties or representations shall be binding unless contained herein.
- The Purchaser indemnifies Pool Safety Net Pty Ltd it’s directors and agents from any claims or recriminations in the event of an accident associated with the direct or indirect use of the pool safety net. and further acknowledges that although the pool safety net is installed with the intention of aiding in child safety no safety guarantees are given by the supplier and the purchaser accepts full responsibility for the use of the pool net.
